I think I can answer your capital loss c/o’s questions, although, as usual, there are no black and white responses. Much depends on the type of entity formed to conduct the activity, such as a Ltd Partnership, LLC, C-Corp, etc. Typically, the majority of the income distribution flowing from the IC entity to the member would be investment income/loss (= ordinary, similar in nature to dividends) with the remaining distribution split between LT and ST capital gain/loss and dividends. The entity will probably be considered a trader for tax purposes which will generally preclude a capital classification to the transactions = no capital gains/losses, except for any gains/losses on index option transactions. There are a host of other tax considerations that come to mind, but too lengthy to get into now. 😉

If you started an investment club and sent me $100k distribution gain divided by long term and short term capital gains, would I be able to offset that against my loss carryovers, respectively? I would think so, but if you didn’t show it by long and short term, I think it would be ordinary income to me, and I would have to fork out 28% to the Uncle on it.
